1. ARE THERE ANY FEES TO PHOTOGRAPH OUR COMMUNITY?

3. DO YOU MAKE FINANCIAL CONTRIBUTIONS / DONATIONS TO COMMUNITIES YOU PHOTOGRAPH?

No. As a freelance photojournalist, I must pay all expenses personally. Consequently, and unfortunately, I cannot afford additional costs, including donations.

4. DO YOU PROVIDE IMAGES TO COMMUNITIES YOU PHOTOGRAPH?

Yes. All communities I photograph are, upon request, provided FREE copies of all workable (i.e. archived) images via a ZIP DRIVE delivered via email. Images on a CD or DVD in JPeg format are available, but at cost (please inquire). Special photo format requests may, but not always, require payment.

5. CAN OUR COMMUNITY USE YOUR IMAGES?

Yes. Each specific Jewish Community may use any image of its respective community for any official community use, commercial or non, without the need for written permission nor payment of royalties to Jono David. NO COMMUNITY MAY RESELL OR REDISTRIBUTE PHOTOGRAPHS OF EITHER ITS OWN COMMUNITY NOR THOSE OF ANY OTHER COMMUNITY FOR ANY REASON WHATSOEVER TO A THIRD PARY WITHOUT FIRST SECURING THE EXPRESSED WRITTEN CONSENT OF JONO DAVID/HaCHAYIM HaYEHUDIM JEWISH PHOTO LIBRARY. Examples of pro bono use include: official community web site postings, community cards, calendars, and newsletters. The main requirement is that all used images are clearly and properly credited to Jono David, the photographer, and/or HaChayim HaYehudim Jewish Photo Library. Additionally, images may be stored for personal use for nonprofit purposes only. Here is a more complete list of Terms & Conditions of Image Use:

NOTES on USAGE OF IMAGES: I make digital files of images I take available (upon request)  to each respective community/sight/individual that I photo free of charge as a way of reciprocating the favors of time, assistance, permission, and welcome that I receive in order to take the photos in the first place. Prints are also available but there are fees (please inquire). NOTE: These Terms & Conditions apply equally to a community, an organization, an individual, or similar, but are applied on a per-situation basis.

 

TERMS & CONDITIONS (T&C) of PHOTO USE: Images are provided to respective communities, organizations, individual, etc. primarily for historical reference by said community/organization/etc. Additional uses of images are permitted but the following Terms & Conditions apply in all circumstances. These T&C are aimed to protect my intellectual copyright of the images. PLEASE READ CAREFULLY, and, in good faith, please honor the contents herein.

 

ONE: Images of your community/organization/individual/etc. may be used for any “official community/organization use”, which may be defined as “any event that is wholly an official community event (including, but not limited to, community announcements in print and/or web, newsletters, community website, calendars, books) that is wholly produced by the community/organization” (i.e. in-house usage only), even for the financial profit of the community/organization. There is no fee nor royalty to be paid to Jono David for said usage.

TWO: Each photo used must be clearly, correctly, and duly credited to Jono David as “Photo © Jono David, HaChayim HaYehudim Jewish Photo Library” or “Photo by Jono David, HaChayim HaYehudim Jewish Photo Library” or “Jono David / HaChayim HaYehudim Jewish Photo Library”.

THREE: Where possible, a link to or listing of www.JewishPhotoLibrary.com should be provided with any publication.

FOUR: Third Party usage of images is strictly forbidden under all circumstances. Third party usage requires an image usage license fee to be paid by the third party to Jono David. So, for example, images may be used for an in-house community publication, but not by a third party publisher doing a feature/book on the community, either in print, electronically, or otherwise.

FIVE: For internet use of photos, when possible, Jono David should be notified of web link to where photos appear, a pdf file, and/or a hard copy of the publication. Notification request also applies to a print publication that is subsequently available on the internet. SEE T&C NINE regarding watermarking photos.

SIX: When possible, Jono David should be provided with one complimentary hard (physical) copy of any printed matter, including books, brochures, calendars, or similar.

SEVEN: Photos should not be resized, cropped, manipulated, color-changed, orientation-changed, reversed, nor should any logo or watermark appear on the images without prior permission (except for the following watermark:  Photograph © Jono David / HaChayim HaYehudim Jewish Photo Library). Placement of any watermark other than as described here is strictly forbidden. SEE T&C NINE regarding watermarking photos.

EIGHT: Digital image file data and/or zip file(s) should not be shared with anyone except essential people involved in archiving the images for the community and/or with people involved in “official community use” (as described in point 1 above). The images in and of themselves may be shared for viewing (e.g. on a computer screen), but image data and zip file(s) sharing is respectfully requested to be limited to essential people and only for essential uses (as described above).

NINE: Images must not be uploaded to any social media web network (e.g. Facebook, Twitter) nor any other website that “reserves the right to use any material posted on its website without credit nor license fee payments to the copyright holder”. NOTICE: Only images with the expressed written consent from me, Jono David, via email, are permitted for such social media web network postings. No image approved for uploading to said social media networks may be posted to such websites or networks without a protective copyright watermark that will read “Photograph © Jono David / HaChayim HaYehudim Jewish Photo Library”. The watermark must be placed either horizontally across the center of the image or corner-to-corner of the image from the bottom left corner to the upper right corner. The watermark should be fully readable but at the least opaque possible so as not to impede the image itself. If you are unable to place watermarks on images yourself, then kindly email me the photo file identification number and I shall do it for you and return the watermarked image via email. NOTE: Images may be placed on your official community website without watermarks because the website is owned and maintained by your community.

TEN: Images must not be uploaded to any website at original full image size and resolution. Before uploading image to your official community website and/or official community Facebook page (or similar), images must be reduced in file size to more than 72 dpi (acceptable quality for viewing on a computer screen). SEE T&C NINE regarding watermarking photos.

ELEVEN: Where possible, images uploaded to any website (e.g. your official community website), must be download-protected (i.e. “right-click” download / save protected). Where download-right-click protection is not possible, images must be watermarked prior to uploading. SEE T&C NINE regarding watermarking photos.

TWELVE: These Terms & Conditions must be provided to any individual or organization with whom either single image date is shared (e.g. emailing an image) or entire gallery data is shared (e.g. sharing a zip file). These T&C are not applicable when sharing only a photo gallery URL page link appearing on www.JewishPhotoLibrary.com.

THIRTEEN: Fees for usage of Jono David photographs will be applied in any and all instances whereby these Terms & Conditions are not observed. For example: If images are published in a community publication without proper accreditation or shared with a Third Party for public or private usage, fees will apply (determined by how the images have been used). Jono’s standard fees as posted on this website will be applied (see PRICES). Additionally, please SEE T&C FOURTEEN.

FOURTEEN: Additional Terms & Conditions may apply under certain circumstances of photo use. Jono David reserves the right to make changes to these Terms & Conditions at any time. Jono David reserves the right to immediately terminate permission of photo usage should images be used outside these Terms & Conditions without expressed written permission.

HaChayim HaYehudim Jewish Photo Library aims to contribute to the preservation of Jewish communities of the world by documenting them photographically. Each photograph gives vision to community life today while safeguarding memories for tomorrow. See MISSION for a full statement.

8. HOW DO YOU INTEND TO USE THE PHOTOGRAPHS?

Unless otherwise noted on this web site or discussed in communications with your community directly, the immediate intention is simply to add the images to the photo library. There are no other specific use/publication plans at this time. However, images in the library are available to the public for purchase by individuals and businesses for public and private use.

9. WHAT PHOTO FORMAT DO YOU USE?

Since August 2009, all images in the HaChayim HaYehudim Jewish Photo Library have been originally created in digital format. The majority of images prior to August 2009 were originally created in 35mm color slide (reversal) film and digital.

10. HOW MUCH TIME IS REQUIRED TO PHOTOGRAPH A SYNAGOGUE? A CEMETERY? ETC.?

Generally, 1-2 hours is required to photograph a synagogue; 1-3 hours to photograph a cemetery. Other sights, such as community centers, schools, mikvah, vary according to sight.

11. DO YOU USE ANY SPECIAL EQUIPMENT OTHER THAN YOUR CAMERA AND TRIPOD?

No.

12. DO YOU USE FLASH?

Yes and no. No for interiors, generally no. For building exteriors, generally yes. Other situations vary.

13. DO YOU HAVE ANY SPECIAL REQUIREMENTS TO PHOTOGRAPH?

Yes. I request that lights be turned on and/or window shutters/blinds be opened. Otherwise, there are no special needs.

14. DO YOU REQUIRE ASSISTANCE WHILE PHOTOGRAPHING?

No. Generally, I prefer to work alone. However, if I must be accompanied for security or other reasons, that is perfectly acceptable.

16. DO YOU PHOTOGRAPH JEWISH EVENTS SUCH AS WEDDINGS OR BAR/BAT MITZVAH?

No. I am available to photograph such events but not as the official photographer. Please inquire via CONTACT.

17. WHO DO YOU WORK FOR?

I work for myself. I am a 100% independent freelance photographer. I am not a photojournalist, journalist, historian, researchers, anthropologist, or other. I do this Jewish photo work primarily for historical archiving. Additionally, HaChayim HaYehudim Jewish Photo Library® is entirely independent. See ABOUT and MISSION.

18. DO YOU SELL IMAGES FOR PROFIT?

Yes. However, please note that the revenue I generate from the sales of my images is far less than the costs of traveling the world to take photographs for the library.

19. HAVE YOUR PHOTOGRAPHS BEEN PUBLISHED?

Yes. My Jewish photos and texts have appeared in such publications as The Wall Street Journal, Hadassah Magazine, Jewish Times Asia, Jewish Magazine, The Japan Times, The Australian Jewish News, The Chicago Jewish News, and The Jewish Telegraph. My travel publications have appeared in The Los Angeles Times, The Boston Globe, The Star Ledger, The Pittsburgh Post Gazette, The Miami Herald, The New Zealand Herald, The South China Morning Post, Photo Life, and Popular Photography. 20. DO YOU REQUIRE US, THE COMMUNITY, TO SIGN ANY AGREEMENT SUCH AS A PROPERTY OR MODEL RELEASE?

No. However, by granting me, Jono David/HaChayim HaYehudim Jewish Photo Library, permission to photograph sights in your community, it is understood that property and model releases are incorporated into that verbal and/or email agreement. Additionally, by granting me, Jono David/HaChayim HaYehudim Jewish Photo Library, permission to photograph sights in your community, it is understood that images are available for purchase by publications and private individuals. Please see LICENSING for further details.

21. WHO OWNS THE PHOTOGRAPHIC COPYRIGHT OF IMAGES IN THE HaCHAYIM HaYEHUDIM JEWISH PHOTO LIBRARY®?

22. CAN THIRD PARTIES SELL OR DISTRIBUTE IMAGES FROM HaCHAYIM HaYEHUDIM JEWISH PHOTO LIBRARY®?

No. I sell images to third parties by agreement between myself, Jono David, and that third party, usually for one-time use. Use is generally limited to, for example, one-time publication in a newspaper to illustrate a related article. Third parties may not use images beyond the terms of our agreement, including reuse. Third parties may not resell nor distribute images from the library to other parties. Third party publications may only distribute images from the library within their publications in concert with the terms of our agreement. Any use of images from the library by a third party other than those of the original agreement constitutes a violation of agreement and copyright infringement. Violations are subject to possible legal action.

23. WHAT WILL HAPPEN TO PHOTOGRAPHS OF OUR COMMUNITY IN THE FUTURE?

HaChayim HaYehudim Jewish Photo Library® aims to photographically preserve Jewish communities of the world for posterity. As such, the entire library will one day be bequeathed to a reputable Jewish agency or organization (perhaps more than one) which can archive and preserve the images properly, indefinitely, and with public access. At this time, no such agency or organization has been designated for this task.
